PROMOTIONS

General Promotion Terms

Promotions, discounts and promotional codes (collectively "Promotions") are valid for the specified time period for online purchases of merchandise only and may be used one time only unless otherwise stated.

One time use Promotions must be used in their entirety in a single purchase. Any amounts not redeemed in the applicable purchase will be forfeited. Promotions cannot be combined with other promotions.

Promotions do not apply to gift certificates, shipping, GST or duties or similar services.

Promotions cannot be applied retroactively to previously placed orders or to orders that have been adjusted.

For promotions requiring a minimum order size, charges for shipping and credits from gift certificates do not count towards the minimum order size requirement.

If you return a gift that was purchased with a Promotion and the Promotion has expired, you cannot apply the expired Promotion to a replacement or future order.

Promotional items are available only while supplies last; We do not issue rain checks for items that run out of stock.

We reserve the right in our sole discretion to extend or terminate a Promotion at any time.

All promotional spend levels and discounts are in Australian Dollars (AUD)

In the event of a return for promotions relating to a 'buy one, get one X' promotion, you must return items in pairs to receive a refund or credit note. You will receive a full refund in the amount of the first qualifying item (paid) that was returned only in the event that the second qualifying item is included in the same return package. No refunds, exchanges or credits will be issued if only one item is returned. 


Crocs x CK Collab and Launch Promotion

Overview

  1. Information on prizes and how to participate form part of these Terms and Conditions. By participating in the 'Crocs v CK Collab and Launch' Promotion (Competition), entrants agree to be bound by these Terms and Conditions.

How to participate

  1. The Competition will run on 20 September 2024 and , whichever is first to occur (Competition Period).
  2. To participate in the Competition, participants must be physically present at the Culture Kings Melbourne store located at and The number of participants is limited to the first fifty (50) participants that satisfy this clause.
  • Participants must retain all clues given in order to complete the scavenger hunt.
  1. Once a participant arrives at the final secret location and presents all required collected at each location to promotional staff, the participant will be invited to roll a large die called the 'CK x Crocs dice' as directed by the promotional staff for the chance to win the prize. One side of the die is marked with the logo of a . If the die lands the 'Golden Croc' side facing up, the participant will be declared the winner and the Competition ends. If not, the participant may return to the back of a queue behind any other participants who have completed the scavenger hunt for an opportunity to try again.
  2. If there is no winner by the end of the Competition Period, participants may provide their name and email address to a staff member involved in facilitating the Competition before the end of the Competition Period. A draw will then be conducted on 20 September 2024 at 5:05 pm AEST at 19-25 Russell St, Melbourne VIC, 3000, and the first valid entry drawn will be declared the winner.

Eligibility

  1. The following eligibility criteria apply:
  • Entrants must provide the requested contact information so that they can be notified if they win; and
  • Employees and directors of the Promoter, its related companies including Culture Kings Pty Ltd and Culture Kings Melbourne Pty Ltd, any Culture Kings retailers, and their immediate families are ineligible. ‘Immediate family’ means spouse, partner, parent, child, stepchild or sibling, whether or not they live in the same household.
  1. Each participant may only collect one Jibbitz (subject to availability of stock) from each location and is not permitted to collect multiple sets to obtain extra attempts at rolling the die.
  2. The Promoter may verify the validity of entries and the identity and eligibility of entrants at any time. The Promoter reserves the right to disqualify any entrant who does not comply with the Terms and Conditions or who tampers with (or who the Promoter reasonably suspects has tampered with) the Competition or the winner selection process or who has otherwise been fraudulent in the course of the Competition.
  3. The Promoter accepts no responsibility for lost or misplaced Jibbitz or clues. A photo of the clue is not accepted.
  4. If requested by the Promoter, an entrant must provide evidence of eligibility to the Promoter.

Winner notification

  1. The winner will be announced on the Culture King's website located at https://www.culturekings.com.au/ on 27 September 2024

Prize details

  1. The Winner will win twelve (12) pairs of Crocs and a $1,200.00 Culture Kings Digital Gift Card.
  • One pair of Crocs will be awarded to the Winner each month for twelve (12) months. A staff member may note the shoe size of the Winner and arrange for the Crocs to be sent by post to the Winner's nominated address. In terms of the design and model of each pair of Crocs provided, the winner will select from the range of Crocs available at Culture Kings' stores each month.
  1. Culture Kings Digital Gift Card: The Culture Kings Digital Gift Card will be awarded on the day of the Competition. The
  2. The Promoter is not liable for the prize or any part of the prize that is lost or stolen after being awarded.
  3. Total prize value is approximately . The exact total prize value cannot be determined because the prices vary between designs and models, and may change over time.
  4. If prizes are returned to the Promoter for any reason such as the address provided by the Winner being invalid, then the Promotor will exercise reasonable attempts to contact the Winner. If the Winner cannot be contacted, then the Winner is taken to have forfeited the undeliverable part(s) of the prize and any subsequent part(s) of the prize.
  5. If a prize is not reasonably available due to circumstances beyond the control of the Promoter, the Promoter reserves the right to substitute any prize (or part of a prize) for a prize of equal or higher value and similar specification.
  6. A prize is not transferable or exchangeable and cannot be exchanged or withdrawn as cash unless otherwise specified in the prize description.
  7. All ancillary costs associated with claiming and using a prize are the responsibility of the Winner.

General

  1. The Promoter collects personal information provided by participants, such as their name and contact details. This is collected for the purpose of conducting the Competition, verifying participants' eligibility, notifying the Winner and publishing their name, validating prize claims and undertaking any investigations to ensure the proper conduct of the Competition. If the requested information is not provided, individuals may not be able to participate in the Competition or claim a prize. Participants' personal information may be disclosed to applicable government lottery authorities and the Winner's name published as specified in these Terms and Conditions or as required by law. Each participant consents to the Promoter using the personal information provided for the purposes set out in these Terms and Conditions.
  2. The Promoter's Privacy Policy is available at https://www.culturekings.com.au/pages/privacy-policy. The Privacy Policy contains information about how individuals may request access to and corrections of information the Promoter holds about them, how to complain about how the Promoter handles personal information and how the Promoter will address such complaints. The Promoter may disclose personal information to prize organisers and service providers for the purpose of conducting the Competition and awarding prizes. The Promoter may store personal information overseas, such as through storage in cloud computing facility located overseas such as in the United States. The Promoter may use third party service providers such as those that assist with managing customer information, fulfilling promotions and sending marketing communications.
  1. Save for any rights or guarantees under the Australian Consumer Law or other terms implied into a contract that cannot lawfully be excluded, the Promoter, Culture Kings Pty Ltd, Culture Kings Melbourne Pty Ltd, their related companies and their respective officers, employees, agents and prize suppliers:
    • make no representation or warranty as to the quality, suitability or merchantability of any prize;
    • exclude any term, condition or warranty that may otherwise be implied into these Terms and Conditions;
    • exclude all liability for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising any way out of the Competition, including but not limited to where arising out of:
      • any technical difficulties or equipment malfunction;
      • any Jibbitz that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter;
      • any variation in stated prize values;
      • any tax liability incurred by a participant or the Winner;
      • any dispute between a participant and any third party relating to the participant's identity or entitlement to a prize; or
      • any use or redemption of the prize.
  1. Each participant indemnifies the Promoter, Culture Kings Pty Ltd, Culture Kings Melbourne Pty Ltd and their related companies against all claims, loss, damage, costs and expenses (including legal costs) suffered or incurred by the Promoter as a result of the participant's conduct in the Competition, any breach of these Terms and Conditions by the participant or their use of any prize.
  2. If the Competition is interfered with or not capable of being conducted as anticipated for any reason beyond the Promoter's reasonable control, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to disqualify any person or to modify or suspend the Competition, as appropriate, to the fullest extent permitted by law.
  3. These Terms and Conditions are governed by the laws of Victoria, Australia.

     

Culture Kings ‘TMNT x Sofles’ by Goat Crew In-store Giveaway Terms and Conditions

Eligibility: Entry is open to all customers who purchase Goat Crew TMNT x Sofles merchandise at participating Culture Kings stores.

Participation: Customers who purchase TMNT x Sofles merchandise at Culture Kings Sydney, Melbourne or Pacific Fair are eligible to participate in the Sharp Shooter game for a chance to win a limited edition 10z Silver Teenage Mutant Ninja Turtles coin.

Customers who purchase TMNT x Sofles merchandise at Culture Kings Brisbane are eligible to participate in the Holy Grail game for a chance to win a limited edition 10z Silver Teenage Mutant Ninja Turtles coin.

Prize Criteria:

Mystery Bundles

  • Products are selected at random and cannot be chosen by the customer. 
  • If you buy one Mystery Bundle in a single order, you will receive different items. If you purchase multiple Mystery Bundles, through one or more orders, there's a chance that you will receive duplicate items of one or more products.
  • All items purchased from a Mystery Bundle are not eligible for return or exchange unless faulty or incorrect item is shipped. In these cases please contact our customer experience team for returns approval.

  • You must, in one transaction, spend over the required threshold on valid full price items to be eligible to receive your Not For Sale item/s with purchase. You will not receive the NFS item/s if you spend the required amount over multiple orders.
  • Not For Sale offers may vary from site to site. Including product and spend threshold.

RELEASES

Footwear Releases

    • All new Jordan footwear releases must be purchased with express priority shipping. This is automatically added to cart during the checkout process. Our Culture Kings team prioritise these orders to have them processed and dispatched on the same day. 
    • Promotional codes including free shipping codes are not valid on hyped footwear releases.
    • Afterpay - Unfortunately, we do not offer Afterpay or other Buy Now Pay Later payment methods on new Jordan footwear releases.
    • One Pair Per Customer - To ensure a fair release for our sneaker heads only one pair per customer can be purchased. 
    • First in first served. Hyped new releases are always expected to sell out very quickly due to the limited quantities made available.
    • No exchanges or size changes to orders will be made
    • Our cart does not reserve or hold items.
    • If a style of shoe in the size you are after is sold out whilst you have a pair in your cart, your cart will be updated and cleared and you will miss out, please select another size.
    • Raffle orders are not eligible to receive NFS packs regardless of the amount spent as they are unlike regular orders because they are processed by our third-party partner EQL, which is separate from regular CK order processing.

EQL Raffle Releases

    • Only humans can enter draws (every entry goes through a 5 step security verification process that confirms you are a human),
    • All entries must be over the age of 18 to enter,
    • 1 entry per person. Multiple entries will be removed,
    • Incorrect details can not be amended. Entrants will need to cancel the entry and re-submit it again with the correct details,
    • Entries after the raffle close time will not be accepted or allowed,
    • If you are successful you will be charged the retail price + postage and handling fee you agreed to when submitting your entry,
    • Verified entries are binding. Once an entry is confirmed, you have agreed to purchase the product if you win (as per Sneaql’s Terms and Conditions),
    • If you do not have the funds available in your account at the time of the draw, you will not be given the opportunity to be debited again,
    • We reserve the right to cancel and close any entries we believe to be dishonest even if selected to purchase.

ORDERING PROCEDURE

You may offer to purchase goods or services described on this website for the price specified on this website.

Your order must contain your name, email address, credit card details and any other ordering information specified on this website.

Your conduct in placing an order on this website acknowledges your acceptance of these terms and conditions.

Once your order has been received we will, with seven (7) days provide an electronic order confirmation.

Payment must be effected in the manner described on the website. Prices are inclusive of goods and services tax. The goods or services are offered for sale only to persons who can make legally binding contracts.

Any orders will become your property at the time that they are shipped to the address provided to us, provided that we have received full payment for the order.

ORDER ACCEPTANCE POLICY

Your receipt of an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to decline or accept your order for any reason. All orders placed may obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting and processing any order. Culture Kings is a retailer to end user customers and does not accept orders from exporters, wholesalers, or other customers who intend to resell the products offered by Culture Kings.

SHIPPING

The delivery times provided in our shipping & returns section (Shipping & Returns) are estimates only. All reasonable attempts to notify you will be made using the details you provided. By agreeing to our terms and conditions you acknowledge all information set forth under our shipping pages, Shipping & Returns.

Generally, delivery of Culture Kings products within Australia takes between 1 to 5 working days based on your location within Australia. We have a dedicated packing team to carefully package your goods to avoid them being damaged in transit. If, for any reason you are unhappy with the condition of your goods on delivery, please contact us immediately.

If you agree to the ‘Authority To Leave’ conditions, you also forgo being able to claim on the products if they go missing in transit. If goods have to be delivered a second time, as there is no authorised person available to sign for them, a re-delivery fee may be charged.

The shipping address for your order is shown at the checkout and on your order. In the event that an incorrect or invalid address was entered, address changes can only made is the order you have placed is still “processing”. We will always attempt but cannot accommodate all address change requests. We accept no liability for any incorrect shipping addresses supplied by you and no refunds will be offered, should you provide an incorrect shipping address.

INTERNATIONAL CUSTOMS AND OTHER CHARGES

Some international orders outside Australia may incur a customs or importation duty charge. We do not have any control over these charges and we are unable to advise what the international customs and duty charges may be payable on orders purchased, as it is based on your own countries laws and regulations.

Duties and other international custom charges are not included in the purchase price and all charges are to be paid by the customer upon delivery of each order paced. Orders cannot be returned to the sender should you fail to pay the applicable importation, custom duties or other charges. We are not responsible for the payment of the duties and other international custom charges. We will never pay these charges on your behalf.

Should you refuse the pay the applicable importations, customs and other duties applicable to your own Country of origin your parcel may be abandoned, and we will not be held responsible or liable for any loss of funds as a result of your failure to make payment. We cannot mark International orders as a gift in order to bypass or reduce any customs fees. This is an illegal practice and as an established business we will not do this.

PRICING INFORMATION

You acknowledge that despite our reasonable precautions, products or services may be listed at an incorrect price or with incorrect information due to a typographical error or like oversight. In these circumstances, we reserve the right to cancel the transaction, notwithstanding that your order has been confirmed and we have received your payment.

If a cancellation of this nature occurs after you have been charged for the purchase, within seven days from the date of purchase, we will issue a credit to the credit card given for the purchase of the goods or service. Should you wish for the credit to be applied to another credit card not used for the original purchase, you must confirm these details in writing to us. We accept no responsibility for rejection of the credit to any credit card given by you.

Prices are subject to change without notice. There may be duties and taxes added to your package by the destination country. You will be responsible for these upon delivery and are not included in your order total. All credit cards are charged in Australian Dollars. Non-Australian currency figures are all approximations based on an exchange rate.

We reserve the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.

CANCELLATION OF ORDERS

We will accept or decline cancellations of any orders placed at our sole discretion. Should you wish to cancel an order placed we must be immediately notified in writing before the goods have been shipped. If the goods have been shipped we reserve the right to refuse the order cancellation request or charge a cancellation fee should we be unable to request the return of the package from our delivery service.

SECURITY CHECKS

All orders are required to be certified by our Security Payment system prior to orders being processed.

All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway provider database where the information is kept confidential.

Culture Kings may require further verification of your order to ensure that orders are authorized by the cardholder. Our security team will contact the customer for verification via email or phone. If a response is not given to our inquiries the order will be cancelled within a 48-hour period of first contact. Verification may be required for a variety of reasons and at the discretion of Culture Kings.

Culture Kings reserves the right to cancel any orders placed under a security check at our sole discretion.

GIFT CARDS

All gift cards are non-refundable or redeemable for cash

All gift cards are redeemable for merchandise at any Culture Kings Australia store or at www.culturekings.com.au

Culture Kings are not liable for any lost or stolen gift cards

All gift cards are valid for 4 years from the date of activation

WARRANTY RETURNS, REFUNDS, EXCHANGES

To the extent permitted by law, no refunds will be provided for any products purchased over the website if you simply change your mind.

Once goods are purchased they are unable to be cancelled unless in accordance with these terms and conditions. No refunds will be provided for cancelled orders once payment has been made.

To the extent permitted by law, any condition, warranty or statutory guarantee which would otherwise be implied or imposed into these terms and conditions is hereby excluded. Where legislation implies or imposes any condition, warranty or guarantee, and that legislation prohibits us from excluding or modifying the application of, or our liability under, any such condition, warranty or guarantee, that condition, warranty or guarantee will be deemed included but our liability will be limited for a breach of that condition, warranty or guarantee to one or more of the following: (a) if the breach relates to goods, (i) the replacement of the goods or the supply of equivalent goods, or (ii) the payment of the cost of replacing the goods or of acquiring equivalent goods.

In cases where a faulty item was received a pre-paid shipping label can be emailed to cover the return costs on the faulty item. Faulty items may be returned outside of the regular returns time frame, providing the item is still under warranty.

We aim to have your return processed within 48 hours of receiving the item; however some faults must be approved by the manufacturer before a refund or replacement can be issued. This process usually takes around 2-4 weeks.

All refunds can only be issued via a gift card or via the same form as the original payment.
