Information on prizes and how
to enter form part of these Terms and Conditions. By entering in the 'Jump for
the Drip' Promotion (Promotion),
entrants agree to be bound by these Terms and Conditions.

Promotion schedule
1.
The Promoter will be running
the Promotion at activation events in Queens Street Mall, Brisbane, near the new
Culture Kings retail store located at 115 Queen Street, Brisbane QLD 4000 (the CK
Brisbane Store) at the following times:
(a) 17th December
2025: 11:00AM AEST to 3:00PM AEST;
(b) 18th December
2025: 11:00AM AEST to 3:00PM AEST;
(c) 19th December
2025: 11:00AM AEST to 3:00PM AEST, and 6:00PM AEST to 8:00PM AEST;
(d) 20th December
2025: 11:00AM AEST to 3:00PM AEST; and
(e)
21st December
2025: 11:00AM AEST to 3:00PM AEST,
Promotional Event
Each Promotional Event
will conclude at the end time specified above or when all tags have been
claimed, whichever occurs first.
Eligibility
The following eligibility
criteria apply:
(a) The Promotion is open to
residents of Australia only;
(b) Entrants must be aged 10
years old or over;
(c) Entrants under the age of 18
years must obtain and be able to provide evidence of consent from their parent
or guardian to participate; and
(d) Employees, directors and
their immediate families of the Promoter, Culture Kings retailers, and their
respective related companies are ineligible. ‘Immediate family’ means spouse,
partner, parent, step-parent, child, step-child, sibling or step-sibling, whether
or not they live in the same household.
2. The Promoter reserves the
right to verify entry validity and entrant eligibility (including identity, age
and residence) at any time and reserves the right to disqualify individuals
deemed to have breached these Terms and Conditions, in its sole discretion.
3. If requested by the Promoter,
an entrant must provide evidence of eligibility to the Promoter.
How to enter
To enter this
Promotion, the following rules shall apply:
(a) Entrants must physically
attend a Promotional Event;
(b) Provided the entrant meets
the eligibility criteria set out in clause Error! Reference source
not found., entrants will be presented with a digital Waiver and Release Form;
(c) Entrants must carefully
review the Waiver and Release Form and only sign it if they agree to all its
contents. If an entrant is under the age of 18 years old, their parent or
guardian must carefully review the Waiver and Release Form and only sign it if
they agree to all its contents on behalf of that entrant;
(d) If the entrant (or their
parent or guardian, for entrants under 18 years old) signs the Waiver and
Release Form, entrants must show a staff member that the Waiver and Release
Form was successfully submitted;
(e) Once the staff member
confirms submission, the entrant will be escorted to a designated zones of the activation
area to participate in the Promotion. There are different zones each with tags
suspended overhead at varied levels. Entrants will be escorted to the relevant
zone based on the entrant's height; and
(f) Entrants will have two
attempts to jump from the designated area and grab a tag that is suspended
overhead.
1.2 If an entrant is
unable to grab a tag after two attempts, they will not win a prize for that
Promotional Event.
1.3 If an entrant
successfully grabs in either attempt, they must present the tag at the counter
of the CK Brisbane Store, preferably immediately, to claim their prize.
1.4 Each entrant may only
obtain one tag per Promotional Event. If an entrant grabs a tag on their first
attempt, they will not be permitted a second attempt. If an entrant grabs
multiple tags on an attempt, the entrant must select only one of those tags to
retain and forfeit the other tag(s).
1.5 The Promoter requires entrants to present their
tag and claim their prize during the same Promotional Event in which the tag
was grabbed.
1.6 Tags must be surrendered by the end of the
Promotional Event and provided to the counter of the CK Brisbane Store.
1.7 Entrants are limited
to one (1) entry (consisting of two (2) attempts) and one (1) prize per
Promotional Event.
Jump safety
1. Due to the requirement to
perform a jump, the Promoter requires that entrants only participate if they
are reasonably confident that they have the coordination and skill to perform a
jump, grab a tag and perform a safe landing (a Safe Jump).
2. Staff reserve the right,
acting reasonably, to refuse the participation of entrants that appear
incapable of performing a Safe Jump.
Winning tags
1. Provided an entrant
successfully grabs a tag in compliance with these Terms and Conditions, the
entrant is deemed a winner of a prize.
2. If a winner does not
present the tag at the CK Brisbane Store counter on the same day as it was
successfully grabbed, the winner will be deemed to have forfeited the prize.
3. Each tag corresponds
to a specific selection of prizes. From that selection, staff will randomly
award a prize at their discretion.
Prize details
1. For each Promotional Event, there is a maximum of four hundred
(400) prizes to be won.
2. Prizes to be won at each Promotional Event include:
1. At the Promotional Event on
19th December 2025, prizes will be allocated across two sessions. A portion
of the four (400) hundred prizes will be available in the first session, distributed
at random, and the remaining of prizes will be added for the second session, in
addition to any prizes not won in the first session.
2. All figures are in Australian
dollars.
3. Tags will be deemed void if they are stolen, forged,
mutilated or tampered with in any way.
4. As there is a limited number of tags available at each
Promotional Event. Once the allocation of tags has been exhausted, no further
prizes will be available.
Prize conditions
1. Prizes are not transferable,
exchangeable or redeemable for cash.
2. If a winner is under the age
of 18 years, the prize will be awarded to their parent or guardian.
3. All ancillary costs associated with claiming and using
any prize (or part of a prize) are the responsibility of the winner, except for
any costs specified in these Terms and Conditions as being part of the prize.
4. The Promoter reserves the right, in its discretion, to substitute a
prize or part of a prize that is unavailable for an alternative of equal value
and/or comparable specification.
5. The Promoter is not liable
for any part of a prize that is lost or stolen after being awarded.
6. The CK Footwear and CK Headwear prizes will be
allocated by the Promoter at its absolute discretion from the available items
to be awarded in each prize category.
7. Customers can use 'CK tokens'
to play machines in-store or participate in in-store events. For more

8. Gift vouchers must be used by the expiry date. Any
unused portion of vouchers will be forfeited. Use of vouchers is subject to the

General
1. It is a condition of participating
in the Promotion that entrants agree to:
(a) participate in all
publicity (including photography) reasonably requested by the Promoter in
connection with this Promotion and the result, free of charge;
(b) consent to the use of
their name, likeness, image and voice (including photo, film and recordings of
same) in any media for an unlimited period without further remuneration for the
purpose of promoting the Promoter's activities; and
(c) sign any reasonable
legal documentation, including but not limited to a release and indemnity, in
the form required by the Promoter and prize organisers.
2. Save for any rights or guarantees under the Australian Consumer Law or other terms
implied into a contract that cannot lawfully be excluded, the Promoter and its
officers, employees, volunteers, agents and any prize suppliers:
(a) make no representation
or warranty as to the quality, suitability or merchantability of any prize;
(b) exclude any term,
condition or warranty that may otherwise be implied into these Terms and
Conditions; and
(c) exclude all liability
for any personal injury or any loss or damage (including loss of opportunity)
whether direct, indirect, special or consequential, arising any way out of the
Promotion, including but not limited to,
where arising out of:
(i) the injury loss or
damage is excluded under the Waiver and Release Form referred to in clause Error! Reference source
not found.;
(ii) any entry or prize
claim that is late, lost, altered, damaged or misdirected due to any reason
beyond the reasonable control of the Promoter;
(iii) any variation in
stated prize values;
(iv) any tax liability
incurred by an entrant or winner;
(v) any dispute between an
entrant and any third party relating to the entrant's identity or entitlement
to a prize; or
(vi) any use or redemption
of the prize.
3. If the Promotion is interfered with or not capable of being conducted as
anticipated for any reason beyond the Promoter's reasonable control, including
but not limited to technical difficulties, unauthorised intervention or fraud,
the Promoter reserves the right, to the fullest extent permitted by law:
(a) to disqualify any person; or
(b) to cancel, terminate, modify or suspend the
Promotion, subject to any written directions from a relevant regulatory
authority.

contains information about how individuals may request access to and
corrections of information we hold about them, how to complain about how we
handle personal information and how we deal with such complaints. We may
disclose personal information to prize organisers and service providers located
in Australia and overseas, for the purpose of conducting this Promotion,
publicising the outcome and co-ordinating the prize.
5. Decisions of the Promoter in
relation to this Promotion are final, provided the Promoter has acted
reasonably and in compliance with all applicable laws. No correspondence will
be entered into where this is the case.
WAIVER AND RELEASE
WARNING UNDER THE AUSTRALIAN CONSUMER
LAW AND FAIR TRADING ACT 2012
If you sign this form, you will be agreeing that your rights to sue us
under the Australian Consumer Law and Fair Trading Act 2012 are
excluded, restricted or modified in the way set out in this form, if you are
killed or injured because the services provided were not in accordance with the
statutory guarantees outlined below.
Under the Australian Consumer Law (Victoria), several statutory
guarantees apply to the supply of certain goods and services. These guarantees mean that we are required to
ensure that the recreational services TF Apparel Pty Ltd or its Culture Kings
retail stores (the Provider, we, us) supply to you:
- are rendered with due care and skill; and
- are reasonably fit for any purpose which you, either expressly or by
implication, make known to us; and - might reasonably be expected to achieve any result you have made known to
us.
Under section 22 of the Australian
Consumer Law and Fair Trading Act
2012, the exclusion of these statutory guarantees is brought to your attention
by this form.
NOTE: The change to your rights, as set out in this form, does not apply if your death or
injury is due to gross negligence on the Provider's part. Gross negligence, in relation to an act or
omission, means doing the act or omitting to do an act with reckless disregard,
with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer
Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian
Consumer Law and Fair Trading Act 2012.

You must read this Waiver and Release before you participate in any
activity on premises of the Provider or the Culture Kings retail store premises
of the Provider, regardless of whether your entry, use or activity on such premises
is offered by us or any third party, including participation in a trade
promotion (Activities).
You (and if you are under the age of 18, your parent or guardian)
acknowledge and agree that:
A. you accept and voluntarily assume all risks associated with the
Activities (including known and unknown risks, not limited to, physical trauma,
strains, bruises, sprains, muscle tears, broken bones, cuts and other serious
personal injury such as, cardiac injuries and heart attacks, permanent
disability, paralysis and death, as well as damage to, theft or loss of
personal property, all of which may be caused by your own actions or inactions
or the actions or inactions of others and the conditions in which these
Activities takes place);
B. to the extent permitted by law, you waive any rights that you may have to
make any actions, demands, losses, injuries, damages, judgements, interruptions
to business or other detriment whatsoever (Claim) against us in connection with the
Activities, and release us and our officers, employees, instructors, agents,
and contractors (Representatives) from, any Claims, liabilities, loss and damage in connection with your
attendance at or participation in the Activities;
C. to the extent that the Activities constitute participation in a
recreational service within the meaning of section 139A(2) of Competition
and Consumer Act 2010 (Cth) (CCA), you agree that we will not have
any liability for death, any physical or mental injury (including the
aggravation, acceleration or recurrence of such an injury), the contraction,
aggravation or acceleration of a disease, or any other liability described in
section 139A(3) of the CCA that may result from or be associated with the
participation in that recreational service, except that this exclusion of
liability will not apply to any personal injury that is suffered by a person
where caused by our reckless conduct (as that term is defined under section
139A(5) of the CCA);
D. subject to paragraph (C), nothing in this Waiver and Release applies to
the extent that it would have the effect of excluding or limiting any
non-excludable rights you may have under the CCA or otherwise under law; and
E. we hold the benefit of the releases and indemnities given under this
Waiver and Release on trust for ourselves and for our Representatives.
I, (and if I am under the age of 18 years of age, any accompanying adult
or guardian) acknowledge, by signing below, I agree to this Waiver and Release.
A parent or guardian agrees to the Waiver and Release individually and on
behalf of the minor. Only a parent or legally appointed guardian may sign for a
minor.
